An expert witness or professional witness is an expert, who by virtue of education, training, skill, or experience, is believed to have expertise and specialised knowledge in a particular subject beyond that of the average person, sufficient that others may officially and legally rely upon the witness's specialized (scientific, technical or other) opinion about an evidence or fact issue within the scope of his expertise, referred to as the expert opinion, as an assistance to the fact-finder. Expert witnesses may also deliver expert evidence about facts from the domain of their expertise. At times, their testimony may be rebutted with a learned treatise, sometimes to the detriment of their reputations. In Scots Law, Davie v Magistrates of Edinburgh (1953) provides authority that where a witness has particular knowledge or skills in an area being examined by the court, and has been called to court in order to elaborate on that area for the benefit of the court, that witness may give evidence of his opinion on that area.

How to admit an expert witness in a mock trial case?
Q. I know what expert witnesses are and what they are used for but I do not know how to ask the judge if I can admit them. I know once you give credit towards the witnesses education and/or experities, you say "your Honor, I would like to admit ___ as an expert witness" I need help asking if I can admit the witness by saying it formally...any information would be great. Thanks

A. Sorry, the above answer is good but isn't always correct. Many times, discovery isn't even requested. This depends on the jurisdiction, because each has its unique discovery rules. The formal language you want is: "Your Honor, I now proffer Dr. X as an expert to the court and request that she be allowed to testify as such." Sometimes, after you feel like you've qualified the witness as an expert, the opposing side may want to take the witness on voir dire (sort of like cross examination of the qualifications) and might ask further questions. Be prepared for this. Good luck in your mock trial. Are you the prosecution or the defense, or is this a civil case?

A. The Judge makes the call, simple based upon testimony by the selected expert before they testify to the jury. "hired gun" is a better term ;-)

A. Yes, you can bring any witness. Payment is for their time and expertise, not to have them take your side. A ture expert witness has probably done this before and has a set rate. If this is a friend who is an expert in a field, you should pay them a fair amount for their time. I'd expect your budget is small since you are in small claims. Good luck
